❗️Immigration Updates

📜As of 01/30/2024, the USCIS has announced a final rule aimed at strengthening the integrity of the H-1B visa program.

👉🏽The H-1B Registration Final Rule introduces several key information to the H-1B visa application process:

✅Beneficiary-Centric Selection Process: Registrations for the H-1B cap will now be selected based on the unique beneficiary rather than the registration itself. This aims to reduce fraud and ensure equal selection chances for each beneficiary, regardless of the number of registrations submitted by an employer.

✅Passport Information Requirement: Starting from the FY 2025 initial registration period, registrants must provide valid passport or travel document information for each beneficiary. This document should be the one the beneficiary intends to use for entry into the U.S. if issued an H-1B visa. Each beneficiary is required to be registered under only one passport or travel document.

✅Flexibility in Employment Start Date: The rule allows for H-1B petitions subject to the cap to request start dates after October 1 of the relevant fiscal year, aligning with current policy.

✅Integrity Measures for Petitions: USCIS will have the authority to deny or revoke H-1B petitions if the underlying registration contained false attestations or was invalid. Additionally, petitions can be denied or revoked if the associated registration fee is declined, disputed, or otherwise unresolved.

✅Registration Fee for FY 2025: The registration fee will remain at $10 for the registration period starting in March 2024. This is ahead of the implementation of the Fee Schedule final rule which will come into effect after the initial FY 2025 H-1B cap registration period.

✅Updated Form I-129: A new edition of Form I-129 reflecting these changes will be available to preview on USCIS’s website with an edition date of 04/01/24. From April 1, 2024, only this new edition of the form will be accepted.

✅Future Rulemaking: The Department of Homeland Security (DHS) plans to publish a separate final rule to address other provisions contained in the Notice of Proposed Rulemaking (NPRM) dated October 23, 2023.
